And so it should come as no surprise that Los Angeles Unified is in court today in an attempt to argue that school construction bonds issued by the L.A. school board last year are “valid and effectual” despite the fact that some of the district’s voters, by a margin of about 38 percent, turned down the bonds.
What you should know is that the city and county have taken over the district’s infrastructure obligations and that L.A. Unified owes the public $2.2 billion just to pay for the things that the district has built in the past couple of decades. But that’s not why schoolboard President Steve Zimmer and school secretary Robert Ronzio are suing the city and county over their school construction bonds — they’re raising concerns about the optics of the move and asking a judge to overturn the election results from last November.
“If this is not an attempt to fix the election with public funds, it’s hard to know what is,” said Michael Beckerman, president of the school board and the lead plaintiff in the suit.
It’s time to step back and look at some basic facts about school construction bonds. The bonds were authorized under a voter-approved school financing law called Measure R. The bond measure was approved by 59 percent of L.A. Unified’s voters, but that was barely enough to trigger the bond sale. The district’s bonds are expected to cost taxpayers about $8 million annually.
Beckerman said the district has projected spending about $500 million on Measure R projects over the next 10 years.
Since the bonds were issued, however, the district has been underfunded by several hundred million dollars. The district’s pension system, for instance, has contributed nothing toward meeting the district’s new measure R-related obligations, said Mike Spiegel, executive director of the California School Finance League, who opposes the lawsuit.
So the district, which makes up about one-third of the $2.2 billion that L.A. Unified was set to borrow, is having to borrow from the general fund and the L.A. County Transportation Agency (LACTA). In the end, L.A. Unified will likely have
