As a result of this consideration, a reasonable person would perceive that the February 2011 Merger Agreement remained in effect. V. Conclusion
The Court is mindful of the desire on the part of Plaintiff to have the Merger Agreement declared void. Because Plaintiff’s cause of action is time-barred, the Court cannot take the extraordinary step of declaring the Merger Agreement void.
